Abstract

The case discussed here is part of the Kashmir report. I have pasted it here separately for the convenience of those who may want to look at specific cases.

Nazir Gojar's case highlights an important aspect of impunity in Kashmir, which is the provision in the Jammu and Kashmir Armed Forces Special Powers Act 1990 providing that any person acting (or claiming to) in exercise of powers granted by this Act cannot be prosecuted without "prior sanction" of the government of India.
