Into the Breach: The Legislative Function of Taboo

Abstract

This note enquires into the the social and legal importance of social opprobrium that rises to the level of taboo. I argue that such opprobrium serves a useful gap-filling function in the legal system, drawing on examples as disparate as anti-Semitism and child “modeling” websites.
