Minnesota: Decades of Decisions and Impact on Sports Law

Abstract
The purpose of this article is to demonstrate that the North Star State provides one of the most substantial examples of how sport and the law intersect. The article begins with the 1970s and explores decade-by-decade many of the major legal claims, cases, judgments, and incidents related to Minnesota and sports law particularly involving allegations of discrimination and violations of due process and equal protection under the law.  The article covers all levels of sport including interscholastic, intercollegiate, Olympic, and professional sport and how all have touched this Midwestern state found in the Eighth Circuit.  The state’s flagship institution-the University of Minnesota Twin Cities-provides numerous examples of impropriety related to playing within its own rules or the bylaws of the National Collegiate Athletic Association. The volume of sports law cases and examples emanating from Minnesota is epic relative to its population, and it was one of the states in the 1970s which addressed the issue of gender discrimination and civil rights even before the enactment of Title IX. Minnesota was one of the first states to consider, via the courts, whether girls could play on the boys’ teams. The impact of Judge Miles Lord and his decisions must not be underestimated. Unfortunately, the University of Minnesota Twin Cities has run afoul of NCAA rules time-and-time again causing often leading to litigation in the courts. Claims of academic fraud, Title IX discrimination, harassment, retaliation, and allegations of violations of several federal and state acts demonstrate that the university has as much to offer sports law enthusiasts as any university in the country. However, it is not the only campus or university in the state that provides sports law material.  The impact that Minnesota has had on the Eighth Circuit Court of Appeals and professional sports is huge in terms of labor relations. Ultimately, this article demonstrates that Minnesota must continue to be a part of the discussion in sports law.
